A Los Angeles man has been sentenced to one year in federal prison for illegally selling and dispensing unapproved erectile dysfunction medication, the federal government announced Thursday.
Michael David Plummer, 21, of Los Angeles, was arrested and charged with selling and dispensing unapproved prescription drugs, a violation of the Food and Drug Administration's (FDA) regulations.
The FDA regulates the sale and administration of prescription drugs, including Viagra and Cialis, and they have not been reviewed by the FDA or the U. S. Food and Drug Administration (FDA).
In January, the FDA issued a warning about the sale and use of erectile dysfunction pills containing sildenafil citrate (generic name: Viagra) in the United States, which is not approved by the FDA.
Pplummer was sentenced to 10 years of probation and ordered to pay $7 million in restitution to the FDA. He also is to serve a 12-month prison term for selling unapproved prescription drugs. He faces up to five years in federal prison.
The case was prosecuted by Assistant U. Attorney Kenneth M. Whitrap and Special Agent in Charge David M. Cohen.
According to court documents, Plummer, who sold and dispensed all types of unapproved prescription drugs, was charged with selling and dispensing the unapproved drugs at three locations in the United States.
The defendants are also ordered to pay the FDA $5 million for the FDA-regulated sale of unapproved drugs in violation of the Federal Food, Drug and Cosmetic Act, which prohibits the sale of drugs that are illegal or potentially dangerous to human health.
According to the United States District Court for the Southern District of Texas, Plummer faces federal criminal and civil penalties.According to the case, he had to pay the FDA $5 million in restitution for selling and dispensing unapproved drugs.
